1. Provider & Scope

Provider: Seo & tool software, Einstein Palais, Friedrichstraße 171, 10117 Berlin

Services: SaaS-based PDF processing tools ("Products") at Seo-Frank, excluding:

Seo-Frank Fax

Seo-Frank Creator

Applicability: These Terms govern all current/future Products on the Website. Conflicting user terms are expressly rejected.

Modifications: Provider may update these Terms at any time.

2. Service Description

Nature of Service:

Products are provided "as-is" without warranties of reliability, availability, or fitness for purpose.

No obligation to provide, maintain, or upgrade Products.

Usage Process:

User uploads documents ("User Documents").

Processing occurs on Provider’s servers.

Processed files are automatically deleted after 1 hour.

User Responsibility:

Verify accuracy of processed files.

Use outputs at own risk.

Prohibited Uses:

Processing sensitive data (e.g., medical/legal documents).

Archiving for legal compliance.

Creating legally binding evidence.

Commercial resale of PDF processing services.

3. Fees

Products are currently free of charge. Future paid services will be governed by separate terms.

4. User Obligations

You agree to:

Hold necessary rights to all User Documents.

Not upload content that is:

Illegal, racist, pornographic, or unconstitutional.

Infringing (e.g., copyright violations).

Refrain from:

Automated scripts/bots.

Spamming via email tools.

Unauthorized commercial exploitation.

5. Third-Party Links

External links on the Website are beyond Provider’s control. No liability for linked content.

6. Liability

No liability for:

Data loss or service interruptions.

Accuracy of processed files.

Exceptions:

Intentional/grossly negligent breaches by Provider.

Personal injury/death under applicable law.

Statutory product liability claims.

7. Intellectual Property

All Website/Product content (layouts, code, graphics) is owned by Provider or licensors.

Permitted Use:

Browser-based access for personal/commercial use.

Integration into third-party websites if:

End users access tools for free.

Seo-Frank branding remains visible.

Not used on illegal/reputational-risk sites.

8. General Provisions

Governing Law: German law (excluding CISG).

Jurisdiction: Berlin-Schöneberg courts for business users.

Severability: Invalid clauses do not void remaining Terms.
